दोनों संसद सदनों में पारित वक़्फ़ संशोधन अधिनियम, पारदर्शिता की ओर अग्रसर एक कदम: अभाविप

अखिल भारतीय विद्यार्थी परिषद, भारतीय संसद के दोनों सदनों में पारित किए गए वक्फ संशोधन विधेयक का हार्दिक स्वागत एवं अभिनंदन करती है। यह विधेयक वक्फ से जुड़े कई विवादों को न्यायसंगत प्रक्रिया के साथ समाप्त करने में सहायक होगा तथा वक्फ काउंसिल में गैर-मुस्लिमों और महिलाओं को शामिल किए जाने से इसे अधिक पारदर्शी, निष्पक्ष एवं प्रामाणिक बनाया जा सकेगा। वक्फ संपत्तियों के ऑडिट और पंजीकरण को अनिवार्य करने तथा सरकारी संपत्तियों की सुरक्षा हेतु निश्चित किए गए प्रावधान भी सराहनीय हैं, इससे इस कानून को और अधिक प्रभावी बनाया जा सकेगा।

वक्फ संशोधन विधेयक के अंतर्गत वक्फ संपत्तियों की पारदर्शिता बढ़ाने के लिए छह महीने के भीतर उनका ऑनलाइन पंजीकरण अनिवार्य होगा, जिससे सरकार को उनकी ऑडिट और निगरानी का अधिकार मिलेगा, जिससे इस कानून के दुरुपयोग को रोका जा सकेगा। वक्फ बोर्ड में गैर-मुस्लिमों और महिलाओं को शामिल किए जाने से विविधता और निष्पक्षता एवं साथ ही निर्णयों में मतों की व्यापकता सुनिश्चित होगी। लोकतांत्रिक प्रक्रिया के साथ लोकसभा तथा राज्यसभा में पारित वक़्फ़ संशोधन विधेयक में केवल दान में प्राप्त संपत्तियों को ही वक्फ संपत्ति माना जाएगा और बिना दस्तावेज एवं सर्वेक्षण के किसी संपत्ति पर वक्फ का दावा नहीं किया जा सकेगा। अभाविप आशा करती है कि संविधान की मूल भावना के अनुरूप, वक़्फ़ संशोधन कानून सर्वसमावेशी, न्यायसंगत एवं वक़्फ़ प्रबंधन में पारदर्शिता को सुनिश्चित करेगा। इसके अतिरिक्त, सरकारी संपत्तियों पर वक्फ के दावे की जांच वरिष्ठ अधिकारियों द्वारा कराई जाएगी और यदि दावा गलत पाया जाता है, तो वह संपत्ति राजस्व रिकॉर्ड में सरकारी संपत्ति के रूप में दर्ज कर दी जाएगी, इससे विवाद की स्थिति में नैतिक एवं प्रामाणिक रूप से सर्वसम्मत निर्णय लेने में सहायता मिलेगी । इस विधेयक में वक्फ ट्रिब्यूनल के फैसलों को हाईकोर्ट तक चुनौती देने की अनुमति एवं अवसर दिया गया है, जिससे न्यायिक प्रक्रिया अधिक पारदर्शी होगी और व्यक्तिगत अधिकारों को भी बल मिलेगा। अभाविप का यह स्पष्ट मत है कि संवैधानिक प्रक्रियाओं के माध्यम से पारित यह दीर्घ एवं बहुप्रतीक्षित न्यायिक संशोधन लोकतांत्रिक प्रक्रियाओं में पारदर्शिता की ओर एक और शशक्त कदम है।

अखिल भारतीय विद्यार्थी परिषद के राष्ट्रीय महामंत्री श्री वीरेंद्र सिंह सोलंकी ने कहा,”दोनों भारतीय संसद सदनों द्वारा पारित किया गया वक्फ संशोधन विधेयक भारत के समग्र विकास में निष्पक्षता के लिए आवश्यक है। पूर्व के वक्फ कानून को लेकर विभिन्न विवाद एवं चुनौतियाँ सामने आती रही हैं, जिन्हें इस नवीन विधेयक के माध्यम से निष्पक्षता के साथ निश्चित रूप से हल किया जा सकेगा। वक्फ काउंसिल में महिलाओं एवं गैर-मुस्लिमों की भागीदारी सुनिश्चित करने का निर्णय इसे और अधिक निष्पक्ष और संतुलित बनाएगा। संप्रदाय के आधार पर भेदभाव न करने का यह प्रयास समानांतर सत्ता की अवधारणा को समाप्त करने वाला है। समस्त भारतीय नागरिकों को इस नवीन कानून को व्यापकता एवं पूर्व के कानून के साथ तुलनात्मक रूप से अध्ययन करना चाहिए एवं तथ्यात्मक समझ के साथ ही विचार मंथन करना चाहिए। अभाविप, सरकार द्वारा पारदर्शिता और न्यायिक सुधार की दिशा में उठाए गए इस महत्वपूर्ण कदम की सराहना करती है और इसे भारतीय समाज में समानता एवं समावेशिता की दिशा में एक ऐतिहासिक पहल मानती है।”

Waqf Amendment Bill Passed by Both Houses of Parliament – A Bold Step Towards Transparency and Credibility: ABVP

Akhil Bharatiya Vidyarthi Parishad wholeheartedly welcomes and applauds the Waqf Amendment Bill passed by both houses of the Parliament. This bill will help resolve several disputes related to Waqf through a just process and inclusion of non-muslims and women in Waqf Council will make it more transparent, impartial and credible. The provisions mandating the audit and registration of Waqf properties and ensuring the protection of government properties are also commendable making this more efficient.  

Under the Waqf Amendment Bill online registration of Waqf properties will be mandatory within six months granting the government thr authority to audit and monitor them hence preventing the misuse of law. The inclusion of non-muslims and women will ensure diversity, fairness and broader consensus in decision-making. The bill, passed democratically in both the Lok Sabha and the Rajya Sabha, stipulates that only properties received through donations will be considered waqf property, and no property can be claimed as waqf without proper documentation and survey. ABVP hopes that in accordance with the spirit of the Constitution, the Waqf Amendment Law will be inclusive, just, and ensure transparency in waqf management.  

Moreover, claims on government properties under Waqf will be examined by senior officals and if found invalid the property will be recorded as government’s in the revenue records creating ethical and credible decision-making in case of disputes. The bill also allows decisions of the Waqf Tribunal to be challenged in the High Court, enhancing transparency in the judicial process and strengthening individual rights. ABVP believes that this long due judicial amendment passed through constitutional procedures is another strong step towards transparency in democratic processes.

ABVP’s National General Secretary Dr. Virendra Solanki stated, "The Waqf Amendment Bill passed by both the houses of Bharatiya Parliament is essential for ensuring fairness in Bharat's overall development. Various disputes and challenges have arisen concerning the previous Waqf law which will now be addressed fairly through this bill. The call for integration of non-muslims and women in the Waqf Council will make it even more impartial. The efforts to eliminate discrimination based on religious sects will put an end to the concept of parallel authority. All bharatiya citizens must study this newly amended law comprehensively and compare it with previous provisions to develop a fact based understanding. ABVP appreciates the government’s significant step towards transparency and judicial reforms and considers it a historic initiative towards equality and inclusivity in Bharatiya society."
